Section 573: Rights of subrogator

The obligations and rights of subrogator shall be as specified in the contract, and, failing such specification, shall be as follows:

(a) All the rights, under the contract, of the person who has sustained the loss or damage shall devolve on the subrogator,

(b) The subrogator under clause (a) may recover from the person who has caused the loss or damage, or from the party to a contract concluded in that respect, if any, the amount or reasonable compensation paid by him or her to the person who has suffered the loss or damage, as well as the costs incurred in having recourse to legal remedies, if any.
