Section 4: Establishment of An Electronic Platform

1) Every entrepreneur conducting e-commerce shall establish an e-platform.

However, there shall not be any impediment for small entrepreneurs or similar domestic entrepreneurs to conduct e-commerce using other e-platforms.

2) On the platform referred to in sub-section (1), the entrepreneur shall provide at least the following details so that the buyer can make an informed decision regarding his business or profession at any time: –

(a) Name of the electronic platform,

(b) Name of the business, address, registered entity, and registration certificate number,

(c) Details of the registered office, head office, and branches and outlets of the entrepreneur, if any, where transactions are carried out,

(d) Details of any separate license obtained to operate a specific type of business,

(e) Details of which business is to be conducted among intermediary or list-based electronic commerce,

(f) Value Added Tax Registration Number or Permanent Account Number,

(g) Email, telephone, mobile number, telefax, social media address (link) to contact the entrepreneur and the email, phone, and mobile number designated for customer service,

(h) Email, telephone, or mobile number and address of the person or unit responsible for hearing complaints, and

(i) Listing number obtained after being listed on the electronic commerce portal pursuant to Section 5.

3) If there is any change in the details referred to in sub-section (2), the businessperson shall update the details on his/her electronic platform within forty-eight hours of the time of such change.

4) The details referred to in sub-section (2) shall be stated in a complete, clear, and easily accessible manner to the consumer.
