Article 131: Vacation of office of Chief Justice or Judge of the Supreme Court

The office of the Chief Justice or a Judge of the Supreme Court shall be vacant in any of the following circumstances:

(a) If he or she tenders resignation in writing to the President,

(b) If he or she attains the age of sixty-five years,

(c) If a motion of impeachment is passed against him or her under Article 101,

(d) If the Chief Justice is removed from his or her office by the President, on recommendation of the Constitutional Council, and the Judge of the Supreme Court is removed from his or her office by the President, on recommendation of the Judicial Council, on the ground that he or she is unable to discharge his or her duties because of physical or mental illness,

(e) If he or she is punished by a court for a criminal offence involving moral turpitude,

(f) If he or she dies.
