Section 33B: Not to Investigate or Prosecute Maliciously

¹1) The investigating or prosecuting officer shall not investigate or prosecute in a defamatory manner to implicate, harm, surprise or protect an innocent person.

2) Whoever commits or causes to be committed an offence under sub-section (1) shall be punished with imprisonment for a term which may extend to six months and shall also be liable to departmental action in accordance with the law relating to his service conditions.
