Section 39: Agreement May be Made

1) In making an investment in any industry jointly by a Nepali investor and a foreign investor, a joint agreement concerning foreign investment may be made with respect to that investment, subject to this Act.

2) The agreement referred to in sub-section (1) shall provide for, inter alia, the terms of the joint distribution of profits earned from the investment and settlement of disputes relating to the distribution of profits earned from the investment and settlement of disputes relating to the investment.
