Section 2: Definition

Unless the subject or context otherwise requires, in this Act:

(a) ¹……………..

(b) “Enterprise” means an establishment as referred to in ²clause (j) of Section 2 of the Labour Act, 2074.

³(b1) “Enterprise owned by the Government of Nepal” means the enterprise of which the whole or most of the shares are owned by the Government of Nepal, and this term also includes the enterprise where such an enterprise owns the entire or majority of shares.

(c) “Fiscal Year” means a period of one year of any enterprise ¹…………. commencing from any particular day of the year for the purpose of final audit of its income and expenditure.

⁴(d) “Employee” means a person working in an enterprise on a salary or wage for the supervisory, administrative, technical, or any other work carried out by them and this term also includes the workers working in the enterprise.

(e) “Salary or wage” means any kind of remuneration payable to an employee in cash for the work done in an enterprise.

Provided that, this term does not include any other amounts to be obtained by an employee for electricity, water supply, medicine, travel, bonus, provident funds or subsidies.

(f) “Management” means the management ⁵under clause (d) of Section 2 of the Labour Act, 2074.

(g) “Department of Labour” means the Department of Labour of the Government of Nepal.

⁴(h) “Labour Office” means the Labour Office established by the Government of Nepal.

(h1) “Labour Court” means the Labour Court ⁶constituted under Section 151 of the Labour Act, 2074.

(i) “Prescribed” or “As prescribed” means prescribed or as prescribed or as prescribed in the Rules framed under this Act.
