Section 7: Deemed to be a Contract

1) In accordance with this Act, if a contract is concluded between a buyer and a businessperson or a seller and a businessperson through electronic means in relation to the transaction of any goods or services, it shall be deemed to have been concluded in accordance with the prevailing law and if any liability arises in accordance with such contract, the party to the contract shall bear such liability.

2) In making a contract in accordance with sub-section (1), the businessperson shall, in addition to the provisions mentioned in the prevailing law relating to contracts, disclose in such contract the necessary information, terms and provisions including the provision of goods or services to the buyer, cancellation, return, exchange, warranty and guarantee, refund.
