Section 103A. Filing a case with investigation

11) If a mixed document with a complaint for investigation is received in accordance with section 103 or if it is sent to the Board for preliminary investigation in relation to the complaint or information received by it if there is no decision from the Board within the period pursuant to sub-section (3) of section 103, then the Police Head Office shall investigate the fault of the investigating officer to at least a police officer of the rank of Inspector of Police in relation to such complaint. In this way, necessary coordination and cooperation can be taken with the Board during the investigation.

2) The investigating officer, pursuant to sub-section (1), shall investigate the case, prepare an investigation report in accordance with the prevailing law and send it to the concerned public prosecutor’s office.

3) On receipt of the report pursuant to sub-section (2), the public prosecutor shall, if the case is decided to proceed or not to proceed, file a case in the district court concerned within thirty-five days of the completion of the investigation.
