Section 103: Preliminary examination

1) If any complaint of any person committing an offence under sections 91, 94, 95, 96, 97, 98, 99 or 100 comes to the Board or the body investigating the matter in accordance with this Act, or if any information regarding such offence is received by the Board by any practitioner or if it is found that such an offence has occurred, the Chairperson shall immediately cause a preliminary inquiry into such complaint through an official level employee of the Board.

2) The officer, pursuant to sub-section (1), may, while making a preliminary inquiry into the complaint, call for necessary documents, particulars and records from the person or institution concerned with the offence.

3) If an offence referred to in sub-section (1) is found to have been committed on the basis of the papers and evidence obtained during the investigation pursuant to sub-section (1), a mixed document containing the complaint, the collected details, and the evidence shall be sent to the Police Headquarters within thirty days to investigate such offence.

4) When sending a missal document with a complaint for investigation pursuant to subsection (3), the name of any officer of the Board may also be sent openly to coordinate and assist in the investigation on behalf of the Board.
